Also, there has to be a judge that isn't bought that would hear this case and strike down the enforcement being it's a fucking b vitamin?

It's going to take lawsuits. If you read the district court judge's ruling on nicotinamide riboside, and how it's a naturally occurring compound that can't be patented, it 100% applies to the MetroBiotech NMN patent. It's only a matter of time before someone files the suit like Elysium did with NR, and we get into the patent fight. You can't fucking patent naturally occurring things in every humans bodies, and you're never going to be on the right side of history claiming that NMN is a "novel food ingredient" when it is in FUCKING BREAST MILK! It's literally in the first food humans have eaten since the beginning of time, not to mention broccoli and edamame! Ohh, so novel... We consume it right after being born, and it's naturally in the bodies of all mammals.

Here we report for the first time on the simultaneous quantitation of nicotinamide riboside, nicotinamide mononucleotide and NAD in milk by means of a fluorometric, enzyme-coupled assay. Application of this assay to milk from different species revealed that the three vitamers were present in human and donkey milk, while being selectively distributed in the other milks. Human milk was the richest source of nicotinamide mononucleotide. Overall, the three vitamers accounted for a significant fraction of total vitamin B3 content. Pasteurization did not affect the bovine milk content of nicotinamide riboside, whereas UHT processing fully destroyed the vitamin. In human milk, NAD levels were significantly affected by the lactation time.

In exclusively breastfed infants, human milk (HM) is the sole source of these essential vitamins required at various steps of growth and development.

It's a major part of what makes breast milk better for babies than formula. It's insane to me that we don't have baby formula with NMN in it! It's as natural as it gets. Novel ingredient?!?

Ummarino et al. (2017) investigated whether NMN and NR would also produce NA when exposed to hot acid or alkaline extraction procedures. And indeed, NR and NMN molecules were hydrolyzed to NA and could account for the total niacin content in the milk samples analyzed [42]. Hence, this indicates that the niacin quantified by microbiological assay includes NR and NMN eventually present in the food matrix.

NR and NMN are actually part of the total niacin numbers in many foods we eat, and we just didn't know it! Creating new methods to test doesn't make the compounds found novel... They were there the whole time. We just didn't know it, or have the methods to see them. Now we do. The idea that NMN is a novel food ingredient that even required an NDI is stupid.

402(f) of the FD&C Act (21 U.S.C. 342(f))

The dietary supplement contains only dietary ingredients which have been present in the food supply as an article used for food in a form in which the food has not been chemically altered

NMN is present in human breast milk, broccoli, and edamame, and that's just what we have found so far. It's for sure in more than that. So yes, NMN is an ingredient that was present in the food supply as an article used for food in a form in which the food was not chemically altered. It's naturally in these things. You don't need to chemically alter them to have them contain NMN, so it is grandfathered in, and does not require an NDI. MetroBiotech's attempt to use the FDA to disallow it as a supplement are shameful, and they will lose eventually.

Replying to Warren_sl · Excited to buy the NMN powder and maybe the holy basil. Still hoping for a supercritical Chamomile or super concentrated lions mane.

I really like the supercritical holy basil. It gives a super nice effect. I love the chamomile as well, but that is ethanol-based. We are working through the legal hurdles of importing high ethanol products from the UK.
