7,8-Dihydroxyflavone is natural too. So it is not a problem for human consumption in the FDA's eyes.
What about opiates though? That's natural too. Or the Kratom alkaloids. Of course 7,8DF isn't recreational so is that what's the deciding factor?

Opiates are not natural, they are semisynthetic. Opium is natural, but scheduled. That's the DEA, not the FDA.
Kratom is legal, but a new ingredient safety certification has not been run. So the FDA says you cannot put it into supplements. Also, some states are specifically passing laws to ban Kratom. Nobody is passing laws to ban 7,8-DHF. Also, it's not really a recreational compound, so the FDA is very unlikely to care about it, unless someone gets hurt by using it.
