As the others have stated, it stifles innovation in the pharmaceutical industry, and allows lobbying to dictate the direction drugs go, rather than what is best for patients. It's all about the money. Forget that tianeptine can help millions of people with depression who do not respond well to SSRIs. No, it is off patent. Nobody is going to sponsor FDA trials for something they cannot have exclusive rights to. So patients lose out, because the product that could help them will not make enough money to justify it.
And what the fuck is up with the ass backwards nutritional supplement (found in nature) vs drug (not found in nature) distinction? Does the fact that something is found in nature make it safer? No! Does the product have to even be natural? No, it just has to be found in nature somewhere! So why is there this almost unregulated market for things, where people can make all sorts of wild claims, and sell bullshit products to unknowing customers, just because the root of a tree in Malaysia contains the substance? It's a silly distinction that has no place in a modern society.
Then you have the blatant profiteering people do, by patenting a racemic structure, then patenting the more potent enantiomer when the patent runs out. Ohh, 10mg racemic Zyrtec (cetirizine) patent ran out. Better fucking patent 5mg levocetirizine, so we can squeeze even more money out of people.
