But my entire point is that this scenario can occur for people NOT driving. Where identification to the level SB1070 requires is not readily available, leading to the arrest of an innocent citizen, which is assuming guilt while waiting proof of innocence.

SB1070 stipulated that an officer could only ask if another violation had been committed. They were not permitted to randomly ask people walking down the street! They had to be stopped for another reason.
