Legal Advice Regarding The Sale of Nootropics

Hello everyone!
I am interested in including a nootropic (either piracetam or aniracetam) in a powder designed to improve mental acuity.
I am aware the that all nootropics are legal in the United States, however sale of them as dietary supplements is not.
How can I get around this regulation so I can include a nootropic as one of my main ingredients?

You can include some nootropics, just not racetams. However, that is only if you want to be 100% compliant to the letter of the law. You could use them, and bet on the fact that the FDA will not come after you, or will take forever to do so. But you cannot sell a substance that is not found in nature as a dietary supplement. I've not only spoken to a few lawyers about it, but also people in both the food and drug division of the FDA. But the FDA does not always enforce to the letter of the law. There are grey areas of leeway they give for certain periods,; whether that be from under-staffing, or a conscious decision to overlook it.
