That is why they found her 20% liable. McDonald's lost the suit due to gross negligence because of the extreme temperature of the coffee. If it was a reasonable temperature, they would have won. It's reasonable to assume the responsibility of minor burns because you spilled a hot drink on yourself. It is not reasonable to assume 3rd degree burns from coffee that was almost 200 degrees Fahrenheit! After further negotiation, she only received $640,000 of the $2.7 Million.

Yes, it was an appeals judge that lowered it. I guess negotiation was the wrong word to use! The legal outcome I find fair. The public perception of her I feel was not; myself included at the time.

You are reading his wording incorrectly. He says that it should be a constitutionally given right. We should NOT leave it to the states, or it will never change. That is how I understood it anyway.
