Actually it was a judge on appeal that lowered the punitive damage amount. Historically the cap has been 10x or more, but the judicial system has been lowering the cap, for instance it is now 3x real damages in the vast majority of cases.

Yes, it was an appeals judge that lowered it. I guess negotiation was the wrong word to use! The legal outcome I find fair. The public perception of her I feel was not; myself included at the time.

You are reading his wording incorrectly. He says that it should be a constitutionally given right. We should NOT leave it to the states, or it will never change. That is how I understood it anyway.
