I tried asking them when I was at 2k subscribers... they rejected me. Will I have a better shot now that we're at 4k subs? :P edit - it's TheNootropicReviewer - https://youtu.be/oqNgj384v2s . People are quite dissapointed in that I can't get them a discount even though I push ND products regularly! :(

Oh okay. I just applied to the affiliate thing. And the email was back in Dec 9 2020 (actually it was only 1300 subs at that time)

Yeah, the denial of to be an affiliate makes sense. Your videos talk about the treatment of diseases a LOT. You talk about anxiety and depression, and how to use our products to treat them. That's a big no-no. We cannot be financially associated with that. There is a lot of risk for us, both civil and regulatory. If you were our official affiliate, and told people they could treat their anxiety with one of our products, we could not only get sued by consumers individually or as a class action, but we could also be held liable for those statements by the FDA. The thing is, there is little risk for affiliates. They can say whatever they want. Sure, you could probably be sued under a class action, and if we were sued for something you said you would get roped into that lawsuit as well. However, you are under no regulatory requirement to not say certain things. So us as a company would be held liable for your statements by the FDA simply because we paid you an affiliate commission for it. The FDA would determine your statements to be our marketing statements because of our business affiliation. You could be held civilly liable, but most affiliates are small. So you would likely just declare bankruptcy. The bulk of the financial damage would be from our end. This is why we have to be careful.
I am going to be speaking to our lawyers about a code for you to give your viewers, though. We need to determine the legal threshold for what constitutes a business relationship. Does a unique code result in tortuous liability passing through to us from your actions, even without any financial compensation? This is an answer our legal team will need to make a determination on.
